Please read the terms of this disclaimer carefully – it contains important information about the service we provide, your rights and limits our obligations to you when certain things go wrong.
Rollin Hard Taxi and Transport Service LLC ("Rollin Hard") has the ability to transport 6 persons at one time. We use a Volvo XC90 as our fleet vehicle for your comfort. After every ride the driver uses a sterile wipe on all surfaces. The vehicle is pet friendly as we allow riders to transport certain pets to and from the Veterinary Clinics. There is no smoking in the vehicle. All riders assume all risks in using Rollin Hard, and hold Rollin Hard harmless of any injury, allergic reaction, fall, or accident (including fatality/death) which may occur.

1. "As Is" Provision: The service (Rollin Hard) and its information are provided "as is," without any guarantees of accuracy, completeness, or suitability for a particular purpose. This means the company isn't promising that the information provided is error-free or will always be available.
2. Limitations of Liability: The disclaimer limits the company's liability for various issues, including:
- Direct or indirect damages:
This includes any damages that arise directly from the service or indirectly from the use of the service.
- Special, incidental, or consequential damages:
This includes damages that are not directly foreseeable but arise as a result of the service.
- Failure of performance, errors, omissions, interruptions, defects, delays:
The company isn't liable for any problems with the service, such as technical glitches, incorrect information, or delays.
- Computer viruses or system failures:
The company isn't responsible for any damage caused by viruses or other technical issues related to the service.
3. Factors Outside of Company's Control: The disclaimer acknowledges that there are factors outside the company's control that can impact service delivery.
These include:
Adverse weather conditions: Extreme weather can cause delays and affect the quality of service.
Accidents involving vehicles: Accidents can disrupt the service and cause delays.
Traffic congestion, road closures, or diversions: These issues can significantly impact travel time.
Mechanical breakdowns: Unexpected breakdowns can also cause delays.
4. Conduct of Others: The disclaimer clarifies that the company is not responsible for the behavior of other customers or third parties, including any defamatory, offensive, or illegal conduct.
5. Intellectual Property: The disclaimer might also address trademarks and other intellectual property rights associated with the service.
Example:
"This taxi service is provided 'as is' without any warranties, express or implied. The company is not liable for any damages arising from the use of the service, including but not limited to direct, indirect, special, incidental, or consequential damages. The company is also not responsible for delays or inconveniences caused by factors outside of its reasonable control, such as weather conditions or traffic congestion"
When you book with us, you will specify a collection time and may specify the time by which you need to arrive at your destination. Whilst we will do what we can to collect you/your passengers at the agreed time and to arrive at the specified destination on time, the very nature of road transport means we cannot guarantee that will happen.
You are responsible for ensuring that the collection time you have agreed allows you sufficient time to reach your destination, taking account of the unexpected events that could occur and delay your journey or our vehicle on its way to collect you. If we feel that the time allowed is unreasonable for the journey, we will notify you at the time of booking. Should you continue with the booking knowing that there is a risk of not making your destination at the prescribed time, our drivers will not be coerced into speeding or breaking any of the road traffic laws, to enable you to make that connection.
Please be aware that there are numerous factors that we cannot prevent against, and which may impact or delay your journey with us. For these reasons our service is provided on the basis that we are not responsible for any inconvenience, losses you suffer, costs you incur or other consequences arising from our failure to provide, or delays in providing, our agreed service because of factors which could reasonably be considered to be outside our reasonable control. Factors outside of our reasonable control include (but are not limited to) adverse weather conditions; accidents involving our vehicles; delays caused by traffic congestion, road works, road closures, accidents or diversions; or mechanical breakdowns which are unexpected and could not have been prevented by a reasonable preventative maintenance program.
Terms & Conditions
01. Areas outside of Cut Bank should always be checked with our dispatch for price and travel time. Operators are happy to assist you if you are unsure of the travel time to allow.
02. Rollin Hard reserve the right to refuse any hire (ride) without reason
03. Payment by card is requested at time of booking. Cash payments require $20 deposit (local) to driver and identification (ID to be returned upon drop off, and any change given.) A larger deposit may be asked for at drivers' discretion for longer range higher cost charter services.
04. Rollin Hard operates on a first available, closest vacant taxi basis and is not a guaranteed service.
05. Whilst every endeavor is made by Rollin Hard to fulfill your booking at the requested time, it is not always possible to achieve. The taxi industry is a demand driven transport service and events out of our control, such as weather and traffic delays and other events can impact on our normal service levels. Some examples, such as, but not limited to, Concerts, Sporting events, and Public Holidays may also affect our service levels. Rollin Hard does not accept liability for any costs incurred for any late bookings or non-arrival.
06. It is the responsibility of the passenger to ensure that any belongings or items travelling are secure at all times. Rollin Hard accepts no liability for the loss, theft or damage to passengers’ property or belongings, however sustained or caused. A charge may be made if belongings have to be delivered to a customer. Lost property may be collected by pre-arrangement. Lost property that is not claimed will be delivered to our local police station within 48 working hours.
07. Rollin Hard reserve the right to cancel any booking without notice and / or suspend access to any of our services without notice.
08. Your contact phone number may be given to your driver for job related questions only. All data that is kept for recording and business purposes will be stored securely.
09. Animals Disability assistance dogs are permitted. Non-assistance dogs are accepted at the driver's discretion and may be required to travel in a carrier which the customer must provide. Dogs should be pre booked, if possible, to ensure there is enough space for their comfort and that of the passengers. We reserve the right to refuse entry to our vehicles of any non-assistance dog that is not pre-booked. Other animals are accepted in vehicles at our discretion, subject to them being in appropriate carriers and that we are notified in advance of their transit.
10. Persons with disabilities are very important and are treated equal to all other passengers. If you need assistance getting your wheelchair in the vehicle we can make that happen. Rollin Hard is not responsible for any injury or fall (including fatality) and is not trained in caregiving, however, we always do our best to assist! Care givers on duty ride free always. Our current vehicle is not equipped to carry motorized wheelchairs, however, if we ever expand enough we will look into the options of vehicles that have this capability.
